THE SERVICES ARE FOR ENTERTAINMENT PURPOSES ONLY. HIGHER DOES NOT OFFER FINANCIAL OR INVESTMENT ADVICE OR RECOMMENDATIONS.

PLEASE READ SECTION 18 CAREFULLY. IT INCLUDES A BINDING ARBITRATION AGREEMENT AND A WAIVER OF CLASS ACTION AND JURY TRIAL RIGHTS.

Your use of some features of the Services may be subject to additional policies or terms ("Supplemental Terms"). If any conflict exists between these Terms and Supplemental Terms, the Supplemental Terms will govern.

1. Overview of the Services

Higher offers a non-custodial platform for exploring and trading Solana-based meme coins. The Services include:

  • Built-in wallet interface
  • Discovery and tracking of trending tokens
  • Aggregated swap functionality
  • Community features and referral programs
  • Educational and entertainment content

The Services integrate third-party protocols but do not host them directly. Higher cannot perform transactions or access your private keys. Higher is not a financial advisor, broker, exchange, or custodian.

2. Non-Custodial Design

Higher does not store, hold, or access your funds, private keys, or wallet credentials. You are solely responsible for maintaining control of your wallet. If you lose access, Higher cannot assist in recovery.

3. Eligibility

Must be at least 18 years old or age of majority.

4. User Responsibilities

You represent and warrant that:

  • You have full control over your wallet
  • Assets were obtained legally
  • You will not use the Services for unlawful activities
  • You are in compliance with applicable laws
  • You will maintain accurate information

5. Token Data & Discovery

Discovery feed and trending lists are informational. Inclusion does not imply endorsement. Token names, tickers, and icons may be spoofed. Higher disclaims liability for decisions based on displayed token information.

6. Trading & Transactions

Swap functionality uses third-party protocols (e.g., Jupiter). All trades are on the Solana blockchain. Higher is not a DEX, broker, or intermediary. Transactions are final. Higher has no control over fees, slippage, smart contract behavior, or execution speed.

7. Automated Actions

Transactions below certain thresholds may be subject to automatic burn or redirection to reduce spam. Such actions are final and non-refundable.

8. Fees & Rewards

Applicable fees include:

  • Transaction fees on Solana
  • Platform service fees
  • Referral fees
  • Optional upgrade fees

Fees may change. All fees are non-refundable.

9. Taxes

You are solely responsible for tax obligations. We do not provide tax advice.

10. Third-Party Integrations

Integrations offered "as-is" and may be discontinued. Higher is not responsible for third-party services.

11. Referral & Rewards Program

Referral abuse may result in loss of rewards or account suspension. Higher may modify or terminate any program at any time.

12. User Conduct

You agree not to:

  • Engage in market manipulation
  • Post false or deceptive content
  • Access through unauthorized means
  • Upload content you don't have rights to
  • Violate any laws

13. Acceptable Use Policy

You may not:

  • Infringe IP rights
  • Harass others
  • Promote hate or violence
  • Exploit minors
  • Distribute malware
  • Bypass security features
  • Circumvent geo-blocks

14. Content Ownership & License

You retain ownership of submitted content but grant Higher a perpetual, royalty-free license to use, display, and promote it.

15. Privacy & Data Collection

Higher collects:

  • Wallet address and activity
  • IP address
  • Device info
  • On-chain interactions
  • Usage logs

We use cookies and analytics tools. Users may request access, correction, deletion, or opt-out at [email protected].

16. Security & Data Protection

Reasonable safeguards implemented. Cannot guarantee against breaches. You are responsible for securing your own devices.

17. Disclaimers

SERVICES PROVIDED "AS IS" WITHOUT WARRANTIES. HIGHER DISCLAIMS ALL WARRANTIES.

18. Limitation of Liability

Higher not liable for:

  • Loss of funds
  • Indirect, incidental, special, consequential, or punitive damages
  • Damages from reliance on token data
  • Damages from user error, smart contract bugs, blockchain downtime, or third-party failures

Aggregate liability capped at the greater of $100 or the amount paid in the past 12 months.

19. Arbitration Agreement

Disputes resolved through binding arbitration under AAA rules in Laramie County, Wyoming. Class action and jury trial waiver. 30-day opt-out by mail to:

20. Termination

We may suspend or terminate access at any time. Certain provisions survive.

21. Governing Law

Laws of State of Wyoming. Litigation in Laramie County courts.

Not liable for events beyond our control.

23. App Store & Platform Terms

You agree to applicable third-party app store terms.

24. Modifications to Terms & Services

We may update Terms at any time. Continued use constitutes acceptance.

  • "Wallet": A non-custodial cryptographic account controlled via private key.
  • "DEX": A decentralized exchange protocol for token swaps on blockchain.
  • "Smart Contract": A self-executing program on blockchain.
  • "Token Discovery Feed": A dynamic list of tokens based on social signals, volume, or activity.
  • "Referral Program": A user incentive system for inviting others.
  • "Spam Wallet": A wallet exhibiting suspicious activity patterns.
  • "Aggregated Swap Functionality": A feature combining pricing from multiple DEXs.

26. Copyright Infringement / DMCA Policy
